Understanding Moroccan Severance Pay (Indemnité de Licenciement)

In Morocco, employees with an indefinite-term contract (Contrat à Durée Indéterminée – CDI) who are dismissed for reasons not constituting serious misconduct (faute grave) are generally entitled to severance pay. This compensation is regulated by Article 53 of the Moroccan Labor Code.

The calculation is based on the employee’s average gross monthly salary over the 52 weeks (1 year) preceding the dismissal and their length of service (ancienneté) within the company. Fractions of a year are taken into account proportionally.

Calculation Method:

The severance pay is calculated in tiers based on the number of years of service:

  • First 5 years of service (1 to 5 years): 96 hours of salary per year of service.
  • Next 5 years of service (6 to 10 years): 144 hours of salary per year of service.
  • Next 5 years of service (11 to 15 years): 192 hours of salary per year of service.
  • Service beyond 15 years: 240 hours of salary per year of service.

To determine the hourly rate, the average gross monthly salary is typically divided by 191 hours (based on a standard working month). For example, if an employee worked for 7 years:

  • Years 1-5: 5 years * 96 hours/year
  • Years 6-7: 2 years * 144 hours/year

The total hours are then multiplied by the calculated hourly rate. There is also a legal cap: the total severance pay cannot exceed the equivalent of 36 months’ salary, unless a more favorable collective bargaining agreement or employment contract provision exists.

Important Note: This calculator assumes dismissal is not due to serious misconduct. If dismissal is for “faute grave,” the employee is typically not entitled to severance pay. Other indemnities, like compensation in lieu of notice (indemnité de préavis) or damages for abusive dismissal (dommages-intérêts pour licenciement abusif), are separate and not covered by this specific calculation.
